lowells debt and CCJ

    Good afternoon.


    I have a problem with my credit report in that it has a CCJ registered from BW Legal / Lowells for an amount of £927. I believe this is from an old credit card which I had when I was previously married back in 2005.


    I have since moved from this address and as such did not receive any documents from BW / Lowells relating to this debt. The CCJ has been put on 21/03/2014.


    How can I approach them in order to get the CCJ set aside and/or negotiate the amount payable since the Credit Card debt was under £700?


    Any help would be much appreciated.

        Even though the Default Judgment (CCJ) was in March 2014 (i.e. over three years ago) you may be able to get it set aside since the claim form wasn't served on your address at the time.

        I think you need to establish what potential Defence you would have if it were to be set aside before deciding your next step since even if the CCJ is set aside you would still have to file a Defence.

        Who was the original creditor and when did you last make any payments or acknowledge the debt in writing to assess whether it might have been Statute Barred when the claim was issued in February 2014 - was anything paid after January 2008?

        Due to the sums involved it would be best to attempt to get Lowells to consent to the set aside in preference to going to court.

        What you want to avoid is any enforcement action too.
