CCJ Defence Letter Help

Hi,

I received a CCJ claim form from Northampton County Court Bulk Centre for a debt which is being handled by a collection agency. It was for payday loan, I have followed advise on here and opted to defend the claim on the basis that I am going to request the collection agency has full permission to deal with the debt.
I am finding contradicting information about what template to use can someone help?

I have read both versions and to be honest a lot of it doesn't make sense to me.....

What happens once I send that to the collection agency?

collection agency only collects a debt on behalf of a Owner & has no rights to issue claims:-

Debt purchaser buys a debt for pennies etc from a Owner and all right to the debt belongs to them and actions taken to collect (or try to collect)

Hi,

The date on the claim form was the 7th September I didn't receive it until the 12/9. How do I start my own thread I am new to this??

use the letters above to get information as stated only request those mentioned on the claim form at this stage.

And remember send letters Recorde Delivery and attach request to your copies.

the example given is a guideline use, adjust to your case , help later with that.


Have you acknowledged the claim on line through MCOL if not do so as that gives you extra time for defence which dealt with later and does not go in until the last day to stop them jumping the gun and thrashing defence ealy stage. defend all on the court form see example thru link getting started, take it one step at a time, and get those 2 letters off

Must read getting started and then follow on reading the others. also look at threads on the same subject on this site to get the picture

Hi Mike,

I submitted my ASO on MCOL today, pretty nervous about the whole thing because I've never dealt with anything like this before. I will send those letters off tomorrow recorded delivery. I have read that the defence needs to be worded with the correct terminology etc which is what I am most worried about.
Any help on this is greatly appreciated as and when it needs doing.

Are these defences often successful?

every case is different, sure others on here will respond soon also and help you through this stage by stage, make sure you let us know anything you send off before you do as not to slip up. we are all nervouse at this stage you are at, but plenty of help on here.
