I am due to be part of TUPE transfer later in the year. I understand my Ts & Cs, including pay are protected, but I understand from my new employer that I will be reporting to a person who is the same managerial level as me whereas I currently report to a head of service. My colleague who also currently reports to our head of service will be reporting to the head of service in the new company.
As this is a reduction in rank or status, surely this is classed as a demotion and leaves the new employer open for grievance / constructive dismissal?
