  • Moneyback PPI - cancellation fee - no letter of authority provided.

    Hi Guys,

Received a letter today from MB PPI requesting a cancellation fee as we didn't reply to previous comm's from the company, namely to return the LOA.
    They quote a price of £180 (150+vat).

As we didn't authorise MBPPI to proceed is this fee legit?

It is stated in the T&C's on the site but we haven't signed anything contract wise.

We actually received our PPI back from a direct complaint and therefore didn't end up instructing these guys.

As the T&C's are noted on the site next to the 'request for information' input fields does this mean we're entering into a contract?

    Thanks,

    Lee

Did you sign anything with MB prior to receiving the LOA's to sign and return ? or JUST the enquiry form on the website ?

Did they send / email you the Claim pack - and did you fill it in / return it ?

Oh is this the company https://www.claimsregulation.gov.uk/...y=-1&status=-1

as there is another company called MoneyBack Limited.

f a Cancellation of this agreement occurs in accordance with
clause 6(b) above, We reserve the right to charge You for the work
undertaken on your behalf in good faith by Us. Where Clause
    7(c) doesn’t apply, a reasonable Cancellation Fee of £150+VAT
(£180.00) will be applied either upon written instructions to Cancel
from You, or as a result of a breach on Your part of Clause 4, for the
work undertaken in processing each of your cancelled Claim(s) up
to the end date of cancellation.
    4.
    You agree to:
    .....
    b)
Provide full authority to Us to deal with the Company on Your
    behalf.[/quote
    .....
    Ahhhh but

    2a)
The contract shall commence on the date You sign and return the
    Letter of Authority to Us
and, unless terminated earlier, as per
Clause 6 or 7 below, will continue until the earlier of:
    I.
Compensation is recovered for You by Us and You have paid the Fee,
    or
    II.
We have advised You in writing that in Our opinion Your Claim is
unlikely to succeed and We are declining to act for You
Looking at them, 10%+VAT fee isn't bad ( in the grand scheme of things)

      ----------------------------

Thanks for the quick reply. Appreciated!

      A) We only put details in the site and they found some a/c numbers from this, sent us the LOA to proceed.

      B) I then realised we didn't need to use them, as a direct approach is easy. Got the money directly.

      C) We ignored the LOA. They then replied with the cancellation fee.

      D) It's definitely 'moneyback ppi'

The fee is actually more than the 10%+ vat! It was a small amount.

Can I get out of this or should I just sign the LOA and take the 10%+ vat?

      Thank you!
