  • Small claims court

    Hi,

I am taking a builder to small claims court and need to prepare my statement for the judge.
I haven't got a clue what to do, is there a template or can anyone advise me how to set out my paperwork.
Ideally if it didn't cost to much, I would prefer someone who is impartial to put it all together for me.

    Kind Regards,

    George

    Re: Small claims court

Are you talking about a witness statement? What is the deadline for exchanging?

A witness statement is supposed to be a factual timeline of the the events leading up to your claim and any evidence you intend to rely on in court. You shouldn't refer to every single piece of evidence you have i.e. huge amounts of correspondence but pick out the key and most important documents that support your case. Obviously be wary not to mislead the Court as you could be sanctioned on that.

An example Witness Statement can be found here -> https://www.dropbox.com/s/lcmxxiun6g...03%29.doc?dl=0

Though you will need to make some amendments to it i.e. under para. 1 it says the claim against me, if you are the claimant it should say something like 'in support of my claim against the Defendant'.

You would need to change para 4 as well to say something like 'judgment be given against the Defendant.'
If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you
