  • Help with Petition for Bankruptcy

    Hi All,

    Hoping someone will be able to guide me on this.

    Brief history:

    Recieved a CCJ in default
    Hearing to set aside failed
    Applied to vary CCJ
    Creditor still hasn't responded to court
    Meanwhile After a Statutory Demand was issued Creitor now issued a Petition for Bankruptcy

    My question is a friend has offered to loan me some money, not enough to pay the debt in full but enough to bring the debt to under the £5000 bankruptcy level.

    Can I just pay this amount to the creditor and state this payment to the DJ at the hearing as a reason for the DJ to dismiss the Petition?

    As always my sincere thanks for all the help I have recieved from this site and hoping someone with more knowledge than me will be able to answer this
