    Hi, can anyone tell me if you can apply for a judgement to be set aside after already attending a hearing to have it set aside before?

    Basically my debt is from an old three mobile account back in 2008 which Lowell then purchased.

    I had not received any correspondence regarding the debt until I received a notice of warrant despite the claimant having my correct address.

    I requesting a set aside due to not knowing of owing any debt to Lowell.

    I had the hearing and was finally told the debt was from the three contract back in 2008. Realising it was from 2008 and only 5 mins left until I went into the hearing

    I wanted to ask the judge to set this aside not on my original defense but to get it statued barred. The representative for Lowell advise I cannot just present evidence 5 mins before entering the hearing so when I went into the hearing I kept quiet. The set aside was dismissed by the judge. Can I now take this back to court and ask for it to be statued barred?

    Never listen to the other side.... they aren't there to help you. If you were only told it was a three contract from 2008 5 mins before the hearing, why is that okay, but not okay for you to say ' now i know that I would defend the case on the debt being statute barred '... ?

    How much is the debt?
    When was the original judgment ?
    When was this set aside hearing ?
    What was your set aside and draft defence based on - just having no knowledge of the debt ?
