  • Consumer Protection Act 2015 Section 50, 54

    Hi

Please can I request members view on the following?

    Consumer Protection Act 2015

Section 50 - Information about the trader or service to be binding

The building contractor verbally gave us a guaranteed completion date, and on his website he states that he gives a guaranteed completion date.

The JCT contract we have with him quite clearly states a completion period of 10 weeks.

On the basis of the guaranteed completion date we decided to give him the go ahead and signed the contract. The JCT contract clearly states a completion period of 10 weeks. In so far (this is week 10) he has been on site about 17 days, some of those are not full working days, one occasion about 2.5 hours.

The completion date is the 12th August 2017 - there is no way he will complete the work.

    Looking at section 54 (7)
Those other remedies include any of the following that is open to the consumer in the circumstances—
    subsection (f) states

"exercising a right to treat the contract as at an end"

So, on 12th August 2017 can we inform him that the contract is at an end?

    It seems too simple!!!!
