    Hello to Everyone,

    My problem is quite complex and I don't know how to proceed with it.

    I think I need a really good divorce lawyer, and I can't afford one. Do any of those guys work on a conditional fee basis in the UK? I'm fairly certain they don't.


    Because- I'm already divorced, but I want money from my ex wife.


    The précis of my situation? As I commit it to writing, it seems more and more ridiculous.


    I'm a Canadian living here in the UK.

    Can anyone tell me if I have a hope of getting any money from my ex- wife.

    My situation, as briefly as possible, is that I am already divorced from an English woman. We were married in Gibraltar, and lived in Spain for 12 years, where we had two children. We fell on hard times financially when the economy crashed.

    We decided that I would move to Canada, as it was the only place to get work, and my now- ex, would sell our home and close down our affairs in Spain. We planned to move to the UK as a family, or possibly Canada, once the house was sold.
    I moved to Canada with £500.

    I lived in a friend's spare bedroom and worked six and seven days a week. I sent her all the money.

    My ex, then told me that we should get divorced temporarily, as a lawyer had advised her that we could prevent the Spanish government from seizing some of our assets that way.
    I signed and returned the divorce papers she sent, literally without reading them. She sent me an email telling me that she would be staying divorced from me after this.

    Now effectively stranded in Canada, separate from my children, I had to go through the costly and time consuming process of being allowed to move to the UK.

    I didn't pay her any money for over a year at this point, as I had none at all. She asked me to begin paying her child support, which I did.
    The home office allowed me to move here late last year.

    I have £ 1900 in the bank.


    Points:

    • My ex brought most (nearly all) of the assets to the relationship. She didn't work.
    • I worked running businesses in Spain for more than ten years.
    • We bought every asset in her name, including the house.
    • She owns properties in Spain, and properties in England. She and her new fiancé are planning the purchase of a new home in Scotland.


    It transpires now that my ex is going to move to Scotland with my children, as she is getting re-married.

    So, please tell me. Is there anything I can do?

    Weird, eh? Can you think of anyone who might be up to fielding this Gibraltar, Spain, England (and if I'm not quick acting, Scotland) related case between an expat Canadian and a Brit?
