I have an ongoing noise issue for 18 months. I am now pursuing my own action against the tenant under Section 82 of the Environmental Protection Act. I have a log of the times of the noises over 18 months (not every day) and the steps I have taken to deal with this (council noise team, police, councillors, neighbours etc). I have also drafted a Notice to serve on the council. He is a council tenant (with a history of being evicted previously by another council), I am an owner. This noise has ruined my life, it is non stop and as I work from home I wake to the sound of hammering every single day.
Is anybody here willing to look over the notice and log before I file it? There doesn't seem to be any current guidance on the format and process. This is an action that individuals can take themselves.
