  • Debt reduction order for homeless/ Live in van owner ?

    Hello there,
    I am hoping to apply for a debt reduction order but have a possible snag in that my only asset is a merc sprinter van that I have converted and has been home for the last three years.

    My debts occurred as a result of supporting a disabled friend through homelessness during the 'austerity'

    I understand that there is a limit on the value of a vehicle of £1000 - mine is worth perhaps ?2000. Is it [possible I might be able to apply for a dro and keep my van as losing it would result in my becoming homeless ?

    All help greatly appreciated

    It looks as though the value of all assets cannot exceed £1000. Get a written valuation from a dealer or two that it is worth less than a grand.

              To qualify for a DRO your total assets cannot be worth more than £1,000 if you live in England, Wales or Northern Ireland, but you can also own one domestic vehicle worth up to £1,000 on top of this.

              You’ll need to provide details of your vehicle including the make, model and registration number. Your vehicle’s value will be checked and if it appears to be worth more than £1,000 you'll need to provide valuations from two independent motor dealers.)))))

              So I wonder if as your total assets are just the car you can get the £1000 limit plus the £1000 car 'allowance' to cover the £2000 value ?

                I assume you mean a debt relief order not a debt reduction order.

                There is no chance you will be allowed to propose a DRO with a vehicle being worth c £2000. Sorry.

                One option would be to sell the vehicle and use it to pay a deposit on somewhere to rent.

                So I wonder if as your total assets are just the car you can get the £1000 limit plus the £1000 car 'allowance' to cover the £2000 value ?
                Imaginative - but no.

                The DRO criteria are incredibly strict.

                  Charging Orders can only be placed on property (or land) registered at the Land Registry.

                  Vehicles are not registered at Land Registry so the OP needn't be worried by that prospect.

                      Would a bailiff expert know the answer to that?

                      My car is in joint names with my daughter (long story about giving it to her but not wanting her to sell it without her controlling mother's permission ) so I don't know if that's an option or whether the OP has anyone they would even want to 'share' the van with.
