    Hi and thank you for reading....

    I had an accident on a roundabout on 11/06/17.

    I was in the left hand lane with the intent of going off the turning straight ahead(3rd exit 12oclock on the dot). I passed the 1st turning and was passing the 2nd when the a car crashed into the font of my car scrapping from my drivers wheel, he was doing quite a speed and ended up stopping a distance down the 2nd turning to which he was heading. as I had not yet completely passed the turn, it was a two lane road, I turned into the turning and he gestured for me to follow his up the road to a safe point to stop, which I did as its a very busy roundabout. As soon as he got out the car he said "going right was we?". still confused and not sure what happened at the time, I said no I was going straight ahead. I did also said in my state that I wasn't sure whos fault it was. we exchanged details and went our separate ways. my car wasn't driving right, going straight meant I had to have the stirring wheel turned. I called my insurance company once I got home, I had to get petrol first as I was very low, this was part of my initial journey plan. When I called admiral they said they was just closing and they would call back the next day. the next day they hadn't called so I called them giving them the details plus a follow up email with a picture of the roundabout and what happen where labelled on it. I also sent a picture of the damage to the car.
    the next day they picked up my car. within a couple of days they told me my car was a right off and paid me £1000 - £125 to pay to the end of the policy.
    I got a new car and insured with them. my NCD had gone down to one year and I had a fault claim on my record. I was under the understanding that once the claim had been sorted and was no longer a fault claim (as I'm sure it was going to be) my NCD would be reinstated and the claimed turned in non fault.
    I didn't hear anything until I got a letter from the others drivers insurance saying they believed I was at fault. I called my insurance to see what we going on but it hadn't been looked at yet by the fault department. the other driver had said that I had gone over into his lane. This is 100% not true!

    about a week later a get a call from admiral saying they are going to settle 50/50 as it was his word against mine. they said they would contact the other driver insurance to see if they agree.
    To say I'm pissed off is an understatement my insurance will go up they £2-300 I year!
    is there anything I can do? there are no witness or cctv.

    Please help!

      Sorry to say, with no witnesses, it is purely your word against his and your insurers are within their rights to negotiate a 50/50 settlement, and it will affect your NCB (unless protected).
      To change this result you would need to withdraw your claim and sue the other driver.
      Costly and stressful, and it could backfire on you.

      What you should have done was to have remained at the scene and not moved the cars (even if it blocked the road) and taken photographs of the two vehicles relative positions, together with measurements.
      That may have supported your view of the incident.
