  • In-law in care home liable for a debt ?

    Hi,
    My father-in-law took out finance for a car a few years ago. A debt collection agency took over the collection. Father-in-law got seriously ill and is now permanently in a state funded care home. My question is, is he still liable for this debt? The mother-in-law is still paying the company £50 a month. What's the best course of action from here as the debt isn't hers. They have no assets either. Hope you can help

    Hello Mat,

    Based on what you've said your father in law would still be liable for the finance however there may be mitigating circumstances which may lead the finance company to write off the debt.
    How much was the finance for, and how much has been paid to date? Does your father in law still have the car and was the agreement ever terminated by the lender or is it still ongoing?

      Hi R0b,
      I'll give you a some more info. The debt was with a bank to pay for a car. The car was returned so that part was sorted out. Original loan amount was 15k. There is 9k still outstanding.
      The debt collectors are called Robinson Way based in Salford. A letter here says it's payable to Idem Services ex HFC bank...
