Hello all here is my situation as follows
We was on Tax credits to which we was told that universal credits has started in our area. to which we looked into it. and yes it looked good (What a surprise we got in the end).
we filled in the application form 1/3/17 then at the end of the filling in the form we had a sanctions one to agree to. (So i phoned them for more information in regards to them)
So I agreed to them.
Next Commitments ok there fine for me as i work 40hrs a week earning £18500.
i phoned them up again in regards to my mrs not working this is where the fun begins.
one phone conversation was with a women who said because you both are treated as individuals your partner will have to be looking for work or she would get sanctioned for it. so i was shocked as how is it people out there as couples can sit on there ass since year DOT not get treated like that.
next phone call i got a sweet middle aged dude who asked me more questions in regards to my work which i explained to him as i did the other lady on the phone and he came back and said your partner would not be forced into full time work due to my working situation and wages. (Turns out in the end that this guy know what he was doing)
3rd telephone conversation over the very same thing as others was another women who said the information you recieved was incorrect from the guy. as she would be expected to be looking for work for a min of 20 hours a week or full time.
with three phone calls not matching the same i asked CAB what a joke they was, they do not fully understand all of how the Universal credit works.
i got back onto unversal credit and the femal work stated if the claim was with-drawn it would not affect the working tax or child tax credits, so i agreed and she with-drawn the claim of universal credits. about 10-14 days after We got a letter days after tax credits was paid saying that my Award has ended on 28/2/17 i phoned tax credits up and they asked me questions and said to fill in a mandatory Reconsideration Request form in i did and sent it off that day. i was told it could take upto a week to register on there system. on the 24/4/17 i phoned them as i did every monday during the time i sent the letter off, they said i would need to get in contact with universal credits and reclaim for that as according to there systems they was to be paying me from the 1/3/17.
i then contacted the Universal Credits and explained the situation which has Developed due to a memeber of there team not advising me correctly, the women on the phone said ok fill the form in again to which i did and she said go through it all and get back on the phone and request it to be back dated. done that and got on the phone and they referred to of to a decision maker.
A Week later attended the jobcentre as had no choice and was met by a lady called sue. she went through all the rubbish and explained that while im working and earning the money i do my partner would not be needing to look for full time work or anything.
so i explained to her that what has happened and now its nearly three months that i will have had no money from hmrc or universal credits.
after we left the jobcentre about two hours after i got a message saying that there was a message in my journal so i logged in and my backdate request has been rejected.
so that day i had to phone them again before going to work and refer it to mandatory reconsideration for that to be given a second look.
Another two weeks goes by then i get this message again saying there was a note on my file.
it was the reply from the mandatory reconsideration. usual bull, and this comment
"Departmental evidence confirms Joe Bloggs and jane doe previously claimed Universal Credit on 01/03/2017, which was closed as they withdrew their claim
Although it would appear that joe bloggs and jane doe were misdirected, unfortunately misdirection or ignorance of one’s rights or of the procedure for claiming, whether reasonable or otherwise, does not feature in the circumstances listed in the Claims & Payments Regulations"
"Whilst we appreciate that their circumstances are difficult we can only apply the law which in this case does not allow for the claim to be backdated"
So here is the fun part.
They know we was miss informed by a member of there staff
They are not willing to backdate me for there mess but im over £700 out of pocket also HMRC want £407.55 of me for an over payment for march.
I have requested cin a complaint i want a SAR report of the information they hold on me and my partner which is still waiting and also all copies of the audio recordings too.
They know that a member of staff miss guided me but im having to pay for there misstake..
anyone know of how or what i should do next???????????
