I am looking for some advice.
I had a tmobile account 01/01/2013 that I believed I had cancelled a few years back after reaching the end of contract term, but apparently I did not complete payments for the entire contract length (according to Cabot). I have no letters to prove I sent a cancellation and no longer have any paper work in relation to the original contract. I have since received a default 10/09/2014 for £222.
The first I became aware of the issue was when I received correspondence from Cabot in late 2016 chasing me for this debt.
After corresponding with Cabot stating I didn't believe the debt was valid and asked them to provide proof and payment history I never received anything proving this. As part of this process I provided proof of payments to Cabot in the form of a screenshot I could see in Noodle showing payment history before the default. I have attached the screen shot that shows a varying balance up and down (this to me demonstrates 18 payments for an 18 month contract)
Cabot state that the green dots show only 15 payments but this could easily be poor administration by tmobile.
I have been informed by EE (tmobile) that the account is with Cabot and basically they're not interested and any credit reporting /changes must be performed by Cabot. I requested proof of letters from cabot that I was ever informed of the debt prior to having a default placed against me. The only letters sent were those of 2016 and an unsigned/undated tmobile letter.
What I dont understand is how Experian have batted away my protests, that there is no proof the data being recorded is correct. They simply ask Cabot if the information is correct and they say Yes? At one point I had 2 defaults on file tmobile and cabot - Experian have removed the tmobile one when I complained.
I have lodged a complaint with the ICO in March 2017 and up until today have had no updates. Since chasing I have been informed they have a backlog and are currently working on Jan 17 complaints.
I cleared this debt a few months ago as the unsettled debt would have potentially caused me work related issues.
Any advice on my next steps would be appreciated? as at this point in time no one can provide me with account payment data or proof there was ever a debt outstanding, I asked Cabot if they could remove the default due to the lack of communication from tmobile but they refused saying it was credit washing.
