    Hi there
    I made an agreement with marstongroup for a TV licence debt ... The amount owing was 425 i was told to pay 127.50 by the 8th of this month which i did and then 49.50 until paid off ...
    Today two bailiffs turned up and demanded the amount in full i told them i had an agreement and he basically called me a liar!! even though he did have down i had paid the 127.50 .
    He said there was no agreement and i declined paying the debt. I told him that if i declined then why did i pay the amount agreed. He wasn't interested would even give me an hour to raise the funds wouldn't agree a payment plan and so i told him to take my things for the value,
    by this point an extra 235 was added on he told me he was going to clear my house inc taking my oven my clothes and children's items and clothing ... Both my children under the age of 16.
    I even phoned the company and said to the advisor i had a plan set up she denied it. I know i made an agreement so i have requested for the recorded phone conversation.
    In the end the other bailiff manage to talk him around to wait and i paid in full, he seemed quite sympathetic but the other was very rude kept inturupting a private conversation i was having with my sister. So I made it quite clear although he was there to sieze my goods he was still in my house and was not able to boss me around and had no authority over me. I remained strong although i felt like crying as this was in front of my children. But thank god its done 😀

    I was wondering if it turns out im right there was an agreement which im 100% sure because i wrote it all down whilst on phone .
    Would i be able to claim bailiff fees back or what would be my rights
    Any help in this matter would be great

    I assume your arrangement was made over the phone. Can you remember the date & approx time and the name of who you spoke to.

      Yes it was on the 26th of April i made the call and at around 10 in the morning and the advisors name was jessica

        Seeing s you have all that I find hard to wonder why they think nothing was done. Was anything confirmed to you in writing? Did you ask or did they say anything would be sent? Did they give a list of dates on which payment had to be made? When did you actually make the first payment?

          When i phoned martsons Jessica the advisors wanted the amount in full i said i could not afford that ..She then asked could i pay half and i said no that was too much ..So she said to me the lowest amount she could take was 30% of the amount 425 ...So my first payment would be on the 8th an amount of 127.50 and i payed it on that day,i also have an email of confirmation..Then every week a payment of 49.50 to which i agreed to be paid every monday.... I told the bailiff this and all his answer was you didn't have an agreement and you declined to pay that's what i have down on my pad in writing .

          I was not sent a payment plan in writing and she did not say she would.

          When you phone it does state all calls are recorded.

          I did try to reason with the baillif and say that you would not decline to pay and then actually make a payment ... but still he kept saying i was a liar and i declined.
          i also said where would i get these figures from and dates i and asked to listen to the recorded phone call but told me that would take 48hrs ...

          i told him that you could clearly see i was willing to pay by making the first payment .
          I also said that i wrote it all down on the back of letter they sent ..I went upstairs to get letter came straight back down and showed him look i wrote it all down ...The date of phone call advisors name and payment amounts and dates ... Nope he was not budging.
          ive had an email today from Marston's as I've made a complaint and they will reply in 3 days ..I've also requested a copy of recorded phone call

            I think before making any other suggestions you should now wait and see what they say - but don't hold your breath. You say you have requested a copy of the phone call - it might be you have to submit a Subject Access Request & pay £10 to get this - let's see what happens.
