    Please help !
We took a loan out with HSBC back in 2012, we were making payments fine, then with one thing and another, we hit some financial problems, so we phoned HSBC, made arrangements to pay back our overdraft, credit card & loan, in amounts we could afford.
we set up standing orders, and payments went out as clockwork, on the 1st of every month, the overdraft is now paid, the credit card is pretty much cleared, but the loan, they suddenly started rejecting our payments. we continued to make the payments for about 3 months, and each month it was bounced back to us !
We contacted HSBC, and nobody seemed to be able to tell us what was going on.
we waited to hear from HSBC, but never recieved any correspondence from them, despite them having our phone numbers, e mail address's etc.
Suddenly today, we have recieved a letter from the courts business centre in northampton, telling us we have to pay this debt or a CCJ order will be issued against us, yet this is the 1st we have heard about it !
Can someone please advise as to what we do with this.
    many thanks in advance

I expect that "letter" from the courts business centre in Northampton is actually a claim form.

Who is named as the Claimant if it's not HSBC?

Sometimes accounts are sold to debt purchasers so if it's not HSBC then don't be surprised but you should have been advised of any assignment. If it was sold on that could explain why your payments to HSBC bounced.

In the meantime this forum has a link to the next steps you need to take which you'll find here > http://legalbeagles.info/forums/show...322#post418322
