  • Notice of Issue of Warrant of control to my recent passed away partner

As the title says, I could really do with some advice on this Notice of issue of warrant of control, my partner who we weren't married or in a civil partnership died on February 16th from Stomach cancer at the age of 43, it has been a very traumatic time for both myself and our two young children, yesterday evening I received through the post an envelope addressed to my partner which I open as there wasn't a sender address or name on it, to my shock it was the above.

The warrant of control was issued on Tuesday 11th, and it basically says that my late partner has in till Tuesday 18th to pay up £331 or bailiff's will turn up at my house , the Notice of Issue of Warrant of control has been issued by Wolverhampton County court on behalf of Arrow Global Limited which just horrifies me, and the distress this will cause my two grieving children.

I was never aware of this debt, I'm not to sure if my partner just kept it away from me, as I was always at work when the post arrived at our home.

I have tried to google some information on this situation but cant seem to find anything, hence why I am asking if anyone has any idea where I can turned to, also to complicate the problem, with it now been a 4 day Easter holiday , I can't seem to get hold of anyone.

My partner didn't have any estate or a will, she basically passed away penniless, she didn't work for two years due to having treatment for cancer, all the major belongs in the house were purchased by me, so I cant see how bailiff's can take my things, of course I don't want them coming to the house full stop.

Any help or advice or a direction I can go with, would be very much appreciated ,thank you.

Take a copy of the warrant and send the copy and a copy of your partner's death certificate back to whoever sent it with a brief covering letter. If not the court then also send the same to the court.

But they are giving me (her) a deadline of Tuesday 18th, so even if I post it off today, it wouldn't get there in time for bailiff's turning up.

You could try emailing Arrow Global's complaints team with scans of the documents and tell them that you are forwarding copies via Royal Mail too (but they'll probably be delayed due to the holiday)?
The email address is customerresolution@arrowglobal.net ... although I'd suggest you send the same to their 'general enquiry' email address too queries@arrowglobal.net

Send the same to Wolverhampton crown court - general enquiries enquiries@wolverhampton.countycourt.gsi.gov.uk and the bailiff section bailiffs@wolverhampton.countycourt.gsi.gov.uk

Hopefully that will get things put on hold at least

And keep a copy of the death certificate by the door/window just in case the bailiffs do turn up.

The NoE will have probably come from your local County Court and it is the County Court Bailiff who will be attending. These are easier to deal with usually, than the private sector who chase Council Tax etc. On Tuesday ring the number and try & get to speak to the Bailiff concerned, if he is not available then ask for the Court Manager and again explain everything to them. Arrow Global will not care as they will try to talk you into paying for the debt outstanding.

Whatever happens rest assured they cannot force entry to your home.
