Hi all I am new to this forum and just wanted to introduce myself. I am a health worker but haven't been able to work since leaving my job last June.I am really hoping I can get some support on this forum for a personal injury claim a solicitor has suggested I make.
Its a long story(I will make it brief though) - I guess it often is!. I worked for the NHS and my job became so unbearable that despite asking for help for over 2 years to make my post more manageable I was not offered help. In the end I was suffering from depression and despite seeing occupational health and my GP and having several months off sick (very unusual for me to have even one day off), I didn't get any help to resolve the problems. It wasn't just me - all of us (midwives) were really struggling and there was a lot os long and short term sickness and a lot of the more experienced and older midwives left because of it. So after trying to return to work after sick leave my manager was so unhelpful that I felt I could not go on and left. I hadn't planned to leave before all this but I just felt I had to get out.
I should have gone to tribunal for unfair dismissal but I missed the time slot due to the depression being so bad and I also broke my leg just after giving in my notice( bit of a bad year) but that also made it hard for me to do things. So when I went to the solicitor about the tribunal he said it was too long ago as ACAS are very strict on times and it had been 10 months by then. However he said he felt I had a strong case for a personal injury claim against the employer - this had never occurred to me but in fact they did really fail me and didn't make it safe for us at work - sometimes we would work for 24 hours which was rediculous. Nothing was doe after my numerous requests for help to the managers and I actually felt in the end they were targeting me to make an example for complaining.
So my real question here is Ive been told there is a good case but I need to write a witness statement before I meet with the solicitor to discuss going forward but I don't know where to start. Still suffering from depression so find these things hard.
Can anyone point me to a good example or got any other advice?
