  • holiday entitlement for part-time workers - conflict of policies?

    Dear All,
I have a question regarding a relationship between two policies : a general government one and the local one relating to holiday entitlement for part time workers. In particular, I wanted to know if one could ingnore a local one if one feels that it's clearly less favourable, or does one still have to comply with it?

    The particular example is:

The general government policy states that:
Part-time workers are also entitled to a minimum of 5.6 weeks of paid holiday each year, https://www.gov.uk/holiday-entitlement-rights/entitlement)
but a local policy says that:

'Annual leave and public holiday entitlement for part-time workers will be calculated prorata to full time hours i.e. if 50% of full time hours are worked then entitlement to annual leave and public holidays will be 50%.'
This means that under the local policy part time workers have fewer days of annual leave if they work 5 days a week.
Is my reasoning correct? Perhaps I am missing something. Some comments would be appreciated. I have raised this with HR who designs policies but no reply.

    Regards,

    Hutia

If you work 20 hours per week regardless of the number of days then you will still get 20 x 5.6 = 112 hours per year as holiday entitlement. No you are not losing out but perhaps it is the way it is written.
