    Hi

    i purchased a second hand car from a dealer. The car wasn't M.O.T. I was told it was and I could get a copy for free witch is not true. The last M.O.T it was in 2014 and the car wasn't even serviced or valeted. It has problems with the VSA and I was told it was nothing to worry about even when I pointed out that it was dangerous as per the instruction manual. I begged for a month for them to take the car back as the battery went flat on day one and they always give me excuses. Turned out that the battery needed replacement and they wanted to charge me for a new one witch I refused as the car was still in the guaranty. They accepted £600 cash in hand and asked me to send PayPal pay,nets as a friend witch I didn't knew at the time that is illegal for a garage to do so as they are avoiding taxes. Also they took the car and lend me one witch they took back without letting me know and I been told that is also illegal. I asked many times for my money back but they just mess me around and say that I should take legal action if I want. I contacted the fair trading but it been over a month and still haven't heard anything. I sent a writing letter to them today and a copy by email giving them a week to respond with a resolution. Another garage been done and they been even got jail time for doing the same over here last year. I just don't know what more to do as it seems like I'm not getting anywhere. I spent a lot of money in endless conversations, post, all my personal effects are in the car also and they just shout at me and insult me on top of it. All their writing messages are in capital letter witch is also insulting and they say I'm not an expert so if they said the car is right I should trust them witch I did at the start. I have done a lot of research and I know they broke the law in many levels so I will like to know what else I can do and if anyone thinks I have a case for compensation. My back been killing me as I been through so much stress with this for the past 2 months that I'm even in medication. I also suffer for depression and the stress really been hard for me to deal with.
    I will appreciate any advice anyone can provide me with.

        Hi and welcome.

        In your post you refer to "over here". Can you confirm in which country you are resident?

        You purchased the vehicle with no MOT, so did you then present the car to an MOT station for testing?
        If you did, what was the test result?

        How do you know the VSA system was faulty? Was it just the indicator light coming on, or did an engineer check the vehicle for you?

        Who has the car at present?
        As per Wales request, do you have any proof of purchase?
        Did you change details of registered keeper to yourself with DVLA?
        As you had no MOT, did you tax the car?
        Did you insure the car in your name?

        How old is the car?
        How much did you pay for it?
        £600 cash and the balance £???? via paypal.
        At least the paypal payment can be verified.

              I live in Cornwall.

              I wasi formed that is illegal for a garage to sell a car without M.O.T. so I begged them for a month to do it. Without it I can't even put the car on my name as they messed me around for ages. The car is in their possession now as they offered to fixed it about 7 weeks ago but never heard of them.

              The VSA warning sign was coming up on the dashboard. That's when they told me they never even serviced the car.

              Without the M.O.T. you can't register your car on your name so the car was outside my house and they took it to repair witch they told me I will have to pay even when the car still in the guaranty. By law garages have to be fully M.O.T before selling it. Another garage got their business taken and jail time over here last year for doing the same. I didn't wanted to do anything and I been trying to push for them to do so. After a month they took the car, as the first month all repairs are covered by them and the second I have to pay a 30%, that I shouldn't have to when the car wasn't even serviced to start with. Their adds says fully valeted, serviced and M.O.T. now they said the car had one month M.O.T. left witch it didn't as I checked the DVLA website.

              The car is from 2004, £1000 in total it was to pay and I only paid £700 of that money before the car was taken to the garage and I asked for my money back. I also have a receipt for the £600 cash as they didn't even provided me with a proper contract. Also have a mssanger chat with him about it so I can prove it. Is a Honda Accord. They give me an M.O.T with the expire date from 2014 and that the last one I can track. They told me I can print one from the website for free witch is another lie. I lived in the Isle of Man for 15 years and recently moved here so all the regulations are different but because it was from a garage I thought it was legal what they done. Is also no records of repairs and a lot of the car history is missing too.

                  Hi sorry I don't get notification so my friend just told me I had messages. My apologies for the delay in replaying. I have sent a letter to them by recorded delivery and a copy by email and they said that hey don't agree wi a lot of it and will like to go to court. I truly believe they don't realise what they are doing and understand the law. I spoke with fair trading about it so I will call again today. They always been very aggressive towards me kind of bullying me to trst them etc Andy shouting at me too. Even their messages are in capital letters. I truly had enough and I been patient but I have reached my limit. I know they were hoping I will just go away and I mentioned the ADR scheme as requested by trading standards and they told me you call them then witch tells me that they are not registered with them neither and I was told by the advisor in tracings that they should be. Trading standards was going to act in my behalf but been 6 weeks and nothing been done yet or any further communications so I will call again today. They don't even had a website and I was told when I went up that they just moved there. They only have a Facebook page Happy car co that hasn't been a happy experience at all.                     So what date did you buy it, what date did they take it back for repair?

                    It would seem that the car is still being repaired now?

                    You have lots of rights under the Consumer Rights Act but people need to understand the full story.

                    See if you can write a history of this with corresponding dates, in date order ie
                    date 1 bought car
                    date 2 complained about battery
                    date 3 complained about MOT
                    eetc

                      can you also post up a copy of the letter you sent them


                      By the way, it is not illegal to sell a car without an MOT, although if they said it had an MOT when it didn't it would enable you to claim misdescription under the Consumer Rights Act.
