    Hi,

    Ive received a letter effectively saying the claimant has not filed the 'Directions Questionnaire with the CCBC" and will need to "on or before 7 days" from service of this order.

    I replied for my company (defendant) in time, rejecting the claim.

    This letter was dated the 11th January 2017 and Ive have not heard anything since. It does say on the letter "If the claimant does not comply with this order their claim will automatically struck out without further order of the court".

    Would I receive a letter from the county court confirming there is further order from the court?

    Would I have been made aware if the claimant has responded during this time?

    Best thing is to call the court after the 7 days of service of the letter to see whether the Directions Q has been submitted by the other side. The court do tend to give a bit of leaway on this so don't rely on it being struck out completely bang on the 7 days from service, and of course once struck the claimant could always apply for relief from the sanction and carry on. Basically I'd leave it 10 days from when you received the letter and then call court to find out the status of the claim.

    ( service is when the claimant would have received the letter - so if you have only just received it, then so will they - the letter date could be mistyped or they were just really really behind in the courts postroom ! )

    Usually its a couple weeks after DQs before you get a notice from the court saying its been transferred to local court and put in small claims/fast track, giving directions for the next steps ( hearing or witness statements etc) but sometimes that can be a couple of months, so you may not necessarily have heard anything yet even if they did submit their DQ .
