I joined the company I am currently working for approximately 4 and 1/2 years ago. Upon joining, I signed a contract that outlined "Terms of Reference" stating I had to pay back training fees for 3 years of training. This had a fixed price for each year (6 years in total) pro-rated, but does not take into account monthly benefits the organisation has from employing me or the increased profit margin they have been able to gain from selling me to customers at an increased rate since I gained the training. I have asked for a breakdown of these costs were calculated but have been denied access to this information as it is "tied up in contracts".
Since then, I have signed a new contract which supersedes all previous written, and verbal, terms, agreements and arrangement. This new contract has no reference whatsoever to repayment of training fees, although does have a debt clause (as I think most contracts do). If I have signed this new contract does it supersede the original terms outlined in my original contract?
I have recently resigned and the company is threatening to deduct my entire wages for this month, as well as giving me 10 days to pay the remaining costs of £9000+
I think this would be an unlawful deduction considering my new terms of agreements. Because of this, I am considering legal action, but would like some advice if others have been in a similar situation or have come across such cases?
