  • Restons Solicitors

In 2006 our loan with HFC bank was passed to Restons who then took us to court and a charging order was placed on our property.
it has only just come to light now that Restons added £3707 in collection charges to the balance which we were not informed of at the time so we could not contest charges.
We have already settled the balance with HSBC as they are called now but Restons are still demanding the £1300 left of their collection charge.
    Any advice would be appreciated.

Was the HFC Charging Order as a result of a Default Judgement because you didn't file an AOS or Defence?

If you didn't contest the claim at the time it's difficult to predict whether you now have the legal right to do that retrospectively (over ten years later).

My suggestion would be to get a copy of the CCJ so you can see exactly what the court ordered and whether there was any provision for ongoing statutory interest to be added.
