  • Barclays Court Summons

    Hello
    I have a court summons from Hoist Portfolio I am 90 % sure its statute barred I have looked on Noodle credit check web site and the account is only listed since Hoist purchased the debt I have filled in the A O S saying I will be defending all the claim
    The question is what do write on the Defense form as I am not sure if it statute barred and do I write to Hoist

          Can you provide a little more info about the case please? for example can you please let us know how much the Claim is for? what do the particulars of the Claim form say?

            Hello Pt2537 first I am thank full for your help

            the claim is for just under £6000.00 costs £410.00 and legal representatives cost £100.00 TOTAL CLAIMED JUST OVER £6000.00

                When was the court claim issue date?
                Who are the legal representatives?
                Have you made CCA &/or CPR 31.14 requests? (If so, have you received any responses?).

                  You say its statute barred? Do you have anything to support this view? Ie when was the last payment made? When did the Creditor serve a Default notice on you? When did the notice expire. we need as much info as you can give really to be able to fully understand the case

                    Thank you both for you replys

                    The defense had to be in to day so I used the CCA and CPR 31.14 L B template. I have also made it clear that I want a running balance.
                    I had forgot about this card and can not find it on noodle and there is no payments from my bank going back 6 and a half years.
                    Can not remember default notice but feel quite sure they will say they sent one even if i didn't get it my word against theirs I fear
                    Thats all the details I have
