  • Blackhorse/mortimer clarke sale of house

    Hi

    I am new to the site but need some urgent advice. I was due to complete the sale of my house on Friday 27th January and this was blocked by Mortimer clarke who refused to remove the restriction imposed by blackhorse in 2011. The issue is blackhorse no longer own the debt and sold it on to DLC ME iii in 2013ish.

    Mortimer clarke are refusing to remove the restriction until the debt is paid. The house is being sold for £76,000 but me and my ex wife owe roughly around £140,000 so therefore are in negative equity. The blackhorse debt is fourth in line, therefore they will never get a pennie.

    My question is, do they have the right to refuse this as the restriction is in the name of blackhorse and not DLC?

    Any help would be most helpful.
