  • letter without prejudice

    Hi to all
My wife would like to make monthly payments to Moorcroft for her credit card debt of £1.00 , this is all we can afford at the moment. She is unwilling to go down the route I have used on my credit card debts because she does not want to go to court as she as no defence apart from hardship for defaulting. Have you got a template letter we can use offering to pay but not admitting the debt. hope this makes sense

    Hi BWG

Has your wife sent CCA requests off to her creditors

    When were the cards opened

Do you still need the template?

      Good morning,

Which card provider was the original creditor?

Is Moorcroft acting on behalf of another company?

        Hi again BWG

Sorry I missed the part of your post about paying but not acknowledging the debt

Sorry but as far as I know that can not be done. Any payment made with the authority of the card holder is seen as acknowledgment of debt

I suppose in theory it may be possible for you to make payments without your wife's knowledge but I doubt that a Judge would accept that and of course if you were caught out it could have serious consequences for both you and your wife

any acknowledgment of the debt is the nail in the coffin, by paying is one of them
