  • Advise needed Medical Negligence ?

    I feel like Citizens advice lately as Friends are coming to me for all sorts so here goes ..... any help greatly appreciated :-
    (Not sure if it's classed as Medical Negligence but didn't quite know what to call it ?)

    A friend was diagnosed with skin cancer last year which was treated and she believed that was the end of it she then had a minor health issue and was then told shortly after that the cancer had spread and she probably had 3/6 months to live . She was devastated and as you can imagine took the news very badly.
    They then decided to gave her a relatively new drug that had been shown to work well with similar cancers and hopefully if nothing else extend her life expectancy as they believed they were treating a secondary cancer.
    It has now come to light 12 months on that in fact it was not cancer at all and the medical professionals involved made an assumption because of her history and without fully checking scans from other hospital. ( I have shortened the facts but it is obviously more in depth)

    This is obviously fantastic news for her and her family but....................
    The upshot of all this is that she cashed in her pensions downsized her house had to stop her extremely well paid job on medical advice, she has
    also been pumped full of drugs which I believe are still in the experimental stage and long term I'm not sure they know what effect it may have (especially on now what they know to be a healthy adult)she has also been on a whole host of other drugs making her quite poorly in fact.

    She would like advice on how to move forward as financially it has been a nightmare for her and her family, and having taken her off all the drugs, 3 months ons he is still very poorly.
    Is there any recourse for her ? any advice greatly appreciated.

    There seems to be a clear case for a clinical negligence action.
    However the course tends to be long and complicated and expensive

    Other than that seek professional advice, possibly on a conditional fee arrangement

        Hi Cathysl,
        Just so you know any medical/clinical negligence claim has to be started by following the health authority's complaints procedure. Solicitors generally won't consider the claim until this step has been taken.
        I am a qualified solicitor and am happy to try and assist informally, where needed.

          I am helping her tomorrow to put a complaint to the PALS at the hospital concerned as like you have stated we thought start there first .
          Thankyou will keep thread updated I am sure I will need lots more input on this
