    Hi,

    If you win in court either in person or post application and you get the letter notice of discontinuation or claim struck out are you given a CCJ on your credit file for 6 years in England and Wales or a default or a decree in Scotland after 5 years?

    Notice of discontinuance is notice that the other side have pulled out of proceeding and struck out is judge' has dismissed a party's side and ended the case

      So, that is not reflected on your credit file/score in anyway? So, the default added 5 or 6 years ago should drop off automatically once the case has ended?

        What ever way a claim concludes win, discontinued. struck out only means the debt was not enforceable via the courts, the debt exists and has a default in place, which will be removed on the 6th anniversary of the creditors original default date, not when the court decision is made.

        A statute barred debt may still have time to run on its default if for instance a payment was made around the time the account was defaulted a common occurrence as some will panic and make a payment when a default is placed.

        SB and default dates are not the same.

          So, there is a possibility you will get a default for 6 years from the last payment date hitting your credit score and in 5 years 364 days the debt purchasers launch a court claim, which if you lose a CCJ gets logged on for another 6 years? meaning you will be discharged after 12 years to repair your credit?

            The default entry will still be remove as usual the CCJ stays as a matter of Pubic Record for 6 years from the date of the judgement.
