Hi I am new here , but I am at my wits end , I am having great trouble with Lowell portfolio - bw legal. the later has taken out a ccj against me there customer of course Lowell . I have written to both asking for a contract for this so called debt with my signature on , the bailiff offererd a ten day extension whilst I obtained this , so I wrote to both b w legal - Lowell my ten days for bailiff are up tomorrow. today I received a reply from Lowell , they have sent me a reconstructed copy of a contract with a printed signature on which is most certainly not mine they also say as it is my address they have the right to pursue this dept . please can some one help.

Lowell has judgment against you, was this judgment by default i.e. you did not respond or defend the claim?

Once a judgement has been made it supersedes the original agreement and they are not obliged to supply any documents.

At this stage Lowell has now been granted a warrant of control and has instructed bailiffs (county court bailiff ?)

Let's have some detailed history,

What was the original debt? £ xxx?
Who was the original creditor?
What type of account was it?
When was this account defaulted?
When was the last payment or written acknowledgment of the debt?
Is the address the one that was relevant when the account was opened?
Please post a copy of the recon agreement after removing personal info, ( if you have problem doing this I'm sure [MENTION=49370]Kati[/MENTION] will help you.

it was for mail order jd Williams personal account late 2014 I have not made any payments since 2014. I have all the time said I have no knowledge of this debt and I ask for original documents with my signature. yes the address is the one when account was opened

Hi every one on this welcome thread, thank you for your prompt reply . I have tried to attach photo copys of the recon consumer credit contract but I am rubbish at this computer thing , I have managed to upload the photos but I do not seem able to attach them I cannot get the photo albums up sorry for this. I do not no if I am jumping the gun but the bailiffs extension of ten days whilst I get the paper work from bw leagal - Lowell is up today and I have no idea what to do now especially if they arrive at my door. I no not to open the door to them plus all the windows are shut . also the illness I have makes me feel I cannot cope with this situation plus being at my wits end is a bit of a downer . maybe I am just panicking . I hope so. any more help is great thank you

Morning, thanks poza for doing those images The agreement does look to be compliant, it's quite a recent one as well if from 2014 so I'm quite surprised this has already been to court and judgment made, and gone to a warrant and for there to be bailiffs there must be a county court judgment against you.

Have you checked on your credit file (noddle) or the registry trust site to see if there is ?

Did the bailiff leave you with any paperwork at all ? Any claim reference number ?

Did you receive the original court papers and did you make any response to them ?

How much approx is the debt ?

Without knowing much more of the back ground it is difficult to help very much, it is quite unusual for Lowell to enforce a judgment by using bailiffs, so I would try and speak with Lowell before the bailiff revisits and if there is a judgment and the debt is one you recognise, then you would probably be wisest to make a payment arrangement with Lowell and ask them to call off the bailiffs. Otherwise if you knew nothing of the court claim you could apply to have the judgment set aside - which would put the warrant on hold for the moment, although it is likely that you would end up having to negotiate payment with Lowell it might give you that breathing space. You wouldn't be able to do that until Monday but you could print out the relevant form and fill it in to show the bailiff if it came to that.

Just need to know a little bit more to have an idea if it is worth applying to set aside or whether you are best off speaking with Lowell/BW Legal to get this sorted.

If he does come back today, either be out - or don't open your door - they can't force entry for a county court debt.

Morning Amethyst thank you for your reply . the bailiffs have not yet been . I received a letter from BW Leagle 24/11/16 which is a notice of pending enforcement action county court bailiffs . I replyed to bw legal with letter I have no knowledge of this debt plus you need to provide me with documents to prove this is my debt. 29/11/16 bw leagal another of the same came plus a issue warrant of control , to this a returned a letter saying I still have not had prof of this debt I also sent one to Lowell + bailiffs at the court house Mansfield . 6/12/16 reply from bailiffs he was holding of for 10 days whilst I obtained info from Lowell - bw leagal. . reply from bw legal they confirm my letter , also states no monies have been paid plus they have requested to Lowell for this documents . going on to say a county court judgmeant was obtained and as a result I am legally due. the last letter I received was from Lowell 13/12/16 which again states I am legally bound to pay the said amount with the documentation which I emailed to your self.

Hi every one please can someone reply , I have posted yesterday and no one has got back to me I still need help on what I should do . I am hopeing bailiffs do not arrive today as I still do not no what my options are . I think as I have not received any more advise do I need to get in touch with bw legal . at the moment I am dreading a knock on my door. please can some one reply.
