  • Uninsured losses.

    Returning home while in Spain, a local car ran into the rear of my car.

    Fortunately after some delay with police etc, we were able to drive home.

    I had not paid for additional cover for a replacement car. So rented a vehicle comparable to my own.

    Eventually AVIVA's legal department refunded my £150.00 that I had to pay before I could get the car from the repairers.

    After considerable delay i was informed that uninsured losses were non recoverable, in Spain, France & Italy.

    I could not even find out if the other driver was charged for any offence. Driving without due care and attention or using a mobile phone while driving.

    Additional cover for insurance seems that they are not interested unless person accident damages is suffered. Just hike up their charges.

    Three times we were asked if we suffered any damage to our selves.

    Can you clarify exactly what has happened and what insurance cover you had.?

    I'm understanding that whilst in Spain you were involved in an incident in which a Spaniard collided with the back of your car.
    You hold him 100% resonsible for the damage.
    Damage was light enough to allow you to continue your return home to UK
    You had the vehicle repaired in the UK, and hired a vehicle whilst repairs were carried out.

    Who are your insurers, what level of cover do you have,and were your insurers aware the vehicle was going to be taken abroad.

    Where does Aviva come into the picture?

    Regardless of the above, one should not expect insurers o cover uninsured losses, and it would not be their responsibility to recover uninsured losses from an at fault third party.
    It would be for the uninsured to pursue the third party.
    If legal expenses cover was included, the insurers may have been advised by their solicitors that there was little chance of recovering the losses from the third party, and so will decline to assist the claimant to pursue the third party.
