Set aside judgement hearing - Evidence

  • Set aside judgement hearing - Evidence

    I am the claimant and there is a hearing on the 23rd of November and i do not want the judgment to be set aside.

    There is a piece of evidence that the defendant has which is crucial.

    How would I force this into the hearing?

    I have similar situation and it is likley you need to put all your evidences into statement and file and serve it before the hearing which will be allocated for set aside procedure.

      What track has been allocated for the case?
      What kind of evidence? (Documentary? Explanatory? etc etc.)......presumably whatever it is must either support your case or be detrimental to the Defendant(s)?

        If the defendant has a piece of evidence that could stop the set aside do you have this? or expect them to give it to the court evidence that helps them lose?
