  • Cabot Financial.

    Morning, I had never heard of this company until 2 days ago when I received a letter from them regarding 'my account with them'. The letter basically says I owe them £1669 which I can reduce to £417 if I pay within 14 days!!. I was completely mystified by this so rang the 'helpline' which proved to be a call centre in India or somewhere similar. The lady I spoke to wasn't very helpful but I was told that this relates to a credit card debt with a company called City Financial. I honestly have no recollection of ever having a credit card with this company. I did however get into financial difficulties around the year 2000 and set up an IVA which I successfully completed around 2006/2007. This credit card could have been part of that agreement but without digging out the papers I can't be sure. I was also told that the last activity on this account was a payment made on 21/05/2007!! This would probably tie in with the end of my IVA.
    I was so shocked by this letter I believed it to be an attempt fraud and I actually reported this to Action Fraud and have received a crime reference number. I also emailed their 'customer services' but they have not seen fit to reply. I have also checked my house phone and can see they have tried to ring, they can't get through because of my call blocker. (ha!).
    I have read previous threads about this company who seem to buy old debts and chase people up.
    Any advice on what to do next? Obviously I am expecting some further correspondence in the next few weeks.

    If your dates are correct then any alleged money owing would be statute barred, ie they can no longer take you to court to recover the debt. They can still hassle you.

    Be careful what you do. If you acknowledge the debt then they can come after you again. Good job the phone blocker did its job. Do not speak to them, demand that everything is in writing. You may care to write back to them stating that any alleged debts would be statute barred. Don't expand, just a simple one line statement is suffice.

    I suspect they know it's statute barred, hence the offer of a settlement of 25% of the original.

      Thanks OSTELL, I emailed them briefly taking care not to acknowledge any ownership of this alleged debt, I also informed them I had made a complaint to Action Fraud (who also believed it is an attempt to defraud me). The date of the last payment is the date their call handler gave me so I can only assume it is correct.

        Good morning,

        Send a request to Cabot for a copy of the agreement for the card account (CCA Request) There's a template in the green box at the top of the " court claim forum".

        There is £1 statutory fee to pay use a postal order " marked for statutory fee only" Cabot has 12 + 2 Working Days to comply.

        Apart from the above I would not contact Cabot at all.

        Does the debt appear on your credit reference files? You can check Noddle free online.

        Cabot is a debt purchaser and probably bought the debt from Citi or because of the age of the debt maybe from another debt purchaser.

        Because of the high level discount offered I suspect Cabot knows this is statute barred, but you need to check your records carefully.

          I have an account with Noddle and I have an excellent credit rating, there are no mentions of any defaults etc.

            Good Vinny, To get Cabot off your back send them a letter stating that you do not acknowledge any debt to them and the debt is statute barred so you will not make any payment, once this gas been done Cabot cannot pursue the debt.

                  If this was a debt in a successfully completed IVA then they can't have another go at collecting it regardless of whether the last payment was more than six years ago or only last week.

                    That's what I thought. I had no credit cards/loans whatsoever from 2001 to 2008 and all the ones I did have were obtained prior to starting the IVA and obviously covered by the IVA.
                    Maybe a fishing expedition hoping to target someone vulnerable who might be panicked into taking up their 'wonderful offer'...
                    I have just found the Completion Certificate and it ran from Jan 2001 to May 2007.
                    Should I send them a copy of my Completion Certificate or just wait?.

                      I suggest you double check the debt was included in your IVA and then send them the written evidence (by post not email) and if you're right about the IVA you will probably not hear from them again.

                      That lady in the call centre helpfully told you the last payment date was in 2007 according to their records. I'm surprised she didn't do the maths and work out for herself it would therefore be SB. Perhaps she did but decided to forget to mention it.

                              Does it show the balance outstanding/written off at the completion of the IVA as £1,669 which is the sum Cabot are now chasing you for?
