2004 - I was introduced to the mortgage broker who remortgaged my home from NatWest Home Loans to Southern Pacific Mortgage Limited.

Initially, I was told that my payments would be charged at a fixed rate of 3.99% for three years. However, the payments increased periodically, throughout. To-date, I have not received any written correspondence from the broker explaining the mortgage he arranged for me; the fees he charged; the commissions he received for the transaction, etc.

I got into a big mess as the mortgage at one point was unaffordable the the introducer said whilst he was trying to get the broker to put me back to my original position since I was told by the introducer that the mortgage company had, made mistakes and were looking into matters to rectify the same and not on interest only but repayment; and was “advised” to take the secured loan with SPPL, as a temporary measure whilst they look into matters to resolve why mortgages increased periodically. Through fear of going into arrears I was forced to take out the second charge.

Therefafter both the introducer and broker became elusive and left me in a mess. Then a friend helped me searche to see who the solicitors were that acted for me in this matter- after I ganing access to copies of the solicitors’ Client Files, there were a number of inconsistencies contained within; such as signatures attributed to me, which were not mine; and alterations made to documents without my knowledge and consent.

I signed a fee agreement to pay the broker £1700 on completion of the loan. However, it came to light that the solicitor, had transferred £3170.62 to the broker from the proceeds of my remortgage. It would appear that the solicitor is complicit in the misappropriation of funds.

I am extremely concerned about the information provided to the mortgage company and did inform them of this in a letter in but the lenders were not very helpful and whenever I had difficulty in meeting payments they were so quick at taking matters to court to repossess the property. Even when we raised concerns of information/documentation and requested the entire file from the outset, the entire contents to date have never been given by the lenders as the broker was the agents of SPML. But Spml keep adding enormous interest, they keep adding insurance knowing that my property is a flat and there is a joint policy with the leaseholders.

A few years ago the lenders tried to repossess the property due to non payment within the documenation provided I noticed that the mortgage application form was not the one I filled in nor with the same information that I provided nor signed by me. But the lenders even knowing this have tried at every opportunity to repossess the property. They keep all adding insurance and other charges. Also they keep sending letters now in the name of Ascenden, Euro-sail, Capstone, Sppl, Spml. I don’t even know who they are it’s a total nightmare. As I would like to know where I could go and meet the CEO of this awful company.
