  • caution orders

    I was married in an EU country approx 3 years ago; my husband was an English doctor residing and working in the EU. The marriage lasted less than two years and I had to do a "runner" because I feared for my life. I have since been in hiding (a long way away) and do not wish for him to know my whereabouts. I have property in England which I bought in 1990 under my sole name. My name is the only name on the deed. My husband never lived in the property nor contributed to it's upkeep in any way whatsoever. He has property in the EU. The marrige did not take place in UK, but in an EU country. I now wish to sell my home in UK and am worried he may have put a caution order on it in order to (a) flush me out or (b) because he will try and make a claim on the property. Is it possible that he could do this? He is not a resident of the UK, but an English national. Would he have a ligitimate claim on my property? I am trying to ascertain my next step should this occur and any advice would be appreciated.

    Who is currently living in your property in England?

    I assume that your husband knows about this property which is why you are concerned even though you purchased it in 1990 (i.e. 26 years ago) long before you say you married him. Maybe he doesn't.

    I also assume that he knows that you know about his properties too.

      Sorry to hear of your problems.

      If a unilateral notice (not a caution as this is already registered property) had been lodged,you should have been notified by the land registry.
      Have you carried out a search to ascertain if a notice has been lodged? http://www.gov.uk/search-property-in...-land-registry
