Statute Barred Debt , is an email considered a "written Acknowledgement of the debt"

  • Statute Barred Debt , is an email considered a "written Acknowledgement of the debt"

    I acknowledged a debt by email that is just short of 6 years old. The debt collector emailed me back saying they could only do this in writing. I did not respond so they then sent me a letter to my old address saying they would take a small payment. Does my email constitute a legal obligation to pay it or does it actually have to be in writing?

      They wanted 6000 I said the letter had been forwarded on to me but could not afford it but could pay 35 a month, I did it as I thought they were going to take me to court. Have I screwed up?

        What a refreshingly honest question

        From what you say you may have acknowledged the debt I'm afraid.

        When do you believe this debt will become statute barred? Is there a slim chance it already has?

            Another question is what is the £6k debt for?

            While you may fear being taken to court, you may fear that less if there was any chance they might lose or you might win

              It was 4K for a credit card, I lost my job and in no time it was 6K. I didn't pay to start with because I had 2 separate debt agencies both saying I owed it to them for slightly differing amounts (well 900 different actually). I think when I wrote the email I had 3 months till the 6 years was up since I made the last payment.

                How long ago since the debt collector chased you and you replied to them by email, or have things gone quiet again?

                Who is the original creditor or has the debt been sold on to a debt purchaser?

                When did you open the account?

                  3 months ago, yes it has gone quiet, the debt has been sold on numerous times, I opened the account about 11 years ago.

                      In which case I would send a s.78 CCA Request to the next person who writes to you because a debt from an account opened in 2005 may have the potential to be unenforceable in court anyway. There's a template letter for that on this forum.

                      If three months have gone by since you sent that email there's hope that the next debt collector won't even know you sent it

                      Maybe keep under the radar until someone writes to you and then respond with the CCA Request. Hopefully the debt will be SB by then.
