  • Another Lowell saga - a half success story!

    Hi all,

    Bit of a success, but as usual not quite the outcome I'm after...yet!

    I've been in an ongoing battle with Lowell for a year now, attempting to get them to justify some figures on an account they claimed I owned, which genuinely did not reconcile with any record I had - put it this way, they came up with a different number every time we discussed the account!

    Anyway, fast forward to now and I've had it in writing from them that they cannot locate any paperwork, they cannot provide a CCA etc and therefore will no longer be pursuing the account. Great - but they are sticking to their guns and reporting a chunky default on my file every month with their made up figure!

    Is there anything I can do to stop this? Specifically, do I have any right to get them to remove the default for the account they can't prove exists?

    they cannot provide a CCA etc and therefore will no longer be pursuing the account
    Was this as a response to a CCA ss77-79 request for info?
    If so, they are only barred from enforcing it unless they do comply with the request.
    They could find the info tomorrow....or next month.....etc.

    Your post implies that a debt does exist; you are only disputing the amount owed. @Debt Camel has some further info

      Well you could put in a complaint that the default amount is incorrect and ask them to produce a statement of account to prove it.

      But realistically a small default will trash your credit record just as much as a chunky one will.

      What is the default date on this debt? Do you think it is correct?
