  • Section 144(1) of the road traffic act 1988

I received a single justice procedure notice on my husband's car. My husband died on 22/1/14 instated and had a BMW. While I was going through probate issues I completed an electronic SORN as an executor of his estate. The car was parked on our private drive, not used. I also sent back the task disk for the refund. I got the car serviced and MOT for the purpose of selling but did not use the car as I have my own car.
Now I have received this notice . This has come as shock as I believed that if the car is SORN, not driven or parked on the public path/road I do not need the road tax nor insurance. Am I correct in believing this that I do not need insurance for this car or did I need the insurance??

Hi Jaylia & welcome to LB.

Firstly, I'm no expert in road traffic law.
AfaIk, s144 is for exceptions to the general rule concerning the requirement for a vehicle to be insured for use on the road & public places (s143).

      Hi and Welcome.

Can you post up a copy of the notice you received please, first removing personal details.
Did you receive (and still have) confirmation of the sorn?
What date did you have the vehicle MOT'd, and presumably by prior arrangement with the MOT station?
