    Good afternoon,

    I got a letter today from capquest saying that have sent my account to Restons Solicitors and that they will be in contact with me soon. The debt is for Littlewoods for £1372.00.

    The reason I got in debt was due to illness and I won't be available for work for the foreseeable future, I am on ESA and can only afford to pay them a small amount as I am debt with other companies. I have read some horror stories about Restons, taking people to court etc and I want to avoid this if possible.

    What is the best way to go deal with this, I know they are not a DCA as such so I am not sure where to start, other DCA's have accept low monthly payments.

    Thank you in advance for any advice etc.

    Hi LaTristesseDurera & welcome to LB.

    When was the last time you paid anything into the account, or acknowledged it in writing?
    Also, when did you sign the original agreement? (ie how old is it?)

      Thank you for the reply.

      I don't remember paying anything in to the account so I will email them and ask them. Capquest started their collection in April 2014. (original agreement with Littlewoods was around 2011)

        If you're sure that the original agreement was 2011, imho it's not really worth emailing them for info.
        As it's Capquest, can I hazard a guess that they are dealing with this on behalf of Arrow?

          I don't think Arrow were ever involved.

          So do I just wait for the letter from Restons and then offer them a certain amount per month?

                  On my credit report it says Capquest registered the default.

                    The debt is for Littlewoods for £1372.00
                    It is therefore regulated by the Consumer Credit Act.

                    I don't remember paying anything in to the account so I will email them and ask them. Capquest started their collection in April 2014. (original agreement with Littlewoods was around 2011)
                    Do you mean: a) you've never paid anything, or b) you have paid some installments but can't remember the dates?
                    When abouts in 2011 did you start it?

                        & how long did you make payments for, or more specifically, when was your last payment?
                        Any written acknowledgement by you subsequent to any last payment (or at any time)?

                              So does that mean that if it becomes statue-barred that will be from the date of opening the Littlewoods account and not when capquest registered the default?
