  • Resign or not?

    I believe that my company is trying to use me as a scapegoat. I had an investigation meeting where the outcome was that there were no grounds for dismissal but I should consider a settlement offer. I accepted this process over the last weekend considering my options and knowing that they were trying to get me out. 3 days later I had not received this offer and I am currently on sick as this has significantly affected my health. I was told that the process took time. I subsequently mentioned that I would like to return to work and I was told that if I did I would be suspended as they may have an investigation meeting which could lead to disciplinary action. I explained that this had already been conducted and they said that this was just gathering facts. The e-mail I received prior to this meeting clearly stated that it was an investigatory meeting. I have received nothing in writing only the minutes of the meeting where it was suggested that I go for a settlement. I was informed that I could be suspended if I returned by a text message?

    I want to get out of the organisation now, I have been there 2 and half years, 3 months notice and considerable amount of leave not taken. What are my options; do I remain on sick and tender my resignation. I don't know what to do and I am the only breadwinner in the household.

    Hi Ways & welcome to LB.

    The usual opinion is don't resign if you can possibly avoid it.
    You have been employed in excess of 2 years, so have full employment rights.
    Ensure if you can that your medical records reflect the fact that your current illness is solely due to the work situation & that there are no 'outside of work' problems which could contribute.
    Submit an official grievance (there should be a published company procedure).
    If you are in a union, contact the rep asap.
    Collate all the evidence you can......a timeline of events can be useful.
    From what you have posted it seems as if the employer is turning what is supposedly an investigatory process into a disciplinary one.

      Thank you for you help. What would the grievance actually be for; can you explain this a little more please?
