Hi there and thanks for such an informative site. I am defending a claim that Howard Cohen Solicitors have brought against me for a credit card debt. In the early 2000s I took out various loans and credit cards as a means of sustaining myself following a difficult divorce. Several years ago I entrusted these debts to Best Solutions Debt Management. Best Solutions however subsequently ceased to operate and sent me no statements. It has been since then that Howard Cohen have pursued me on behalf of Barclaycard for a debt they say I have. I have no idea whether the debt is mine. It does not appear on my credit reference nor do I have any paperwork etc in relation to it.
Howard Cohen have produced the following 'evidence' in their witness statement:
1. A reconstituted agreement (unsigned) - they claim I signed an agreement with Barclaycard in April 2006
2. A copy of a letter sent by another debt collection company
3. A reconstituted copy of terms and conditions
4. They state in their statement that I used the card "every now and then"
I am contesting the debt and am due to appear in Court on Tuesday 4th October and would be grateful for any advice with regard to what I should do on the day.
