    I have been following advice on this forum in the past and found it very helpful, so I have signed up today for some advice.

    I defaulted on an old Alliance & Leicester/MBNA credit card and was making £10 monthly payments up until 2012 when MBNA passed the debt on to Aktiv Kapital and then to PRA Group, who I have ignored.

    I received a letter from local solicitors/and PRA a couple of weeks back advising that if I didn't arrange a payment in full or come to an arrangement with them they would send to their litigation team. I was panicked at this and came on here and seen that I should send PRA a CCA letter which I did and they have sent me out the attached. It is a one page 'agreement' with my typed name and address at the top. They have also sent me numerous cover pages of statements with my balance and details on. Can someone advise if this is sufficient and acceptable or should I be requesting anything else? I am really terrible at all this stuff and I am afraid they are going to send me a county court claim form in the coming days.

    I also need to add as per the attachment, behind this in the same envelope I received another persons CCA request, which details her agreement and amount owed and all her personal information. What should I do about this?

      I would really appreciate anyone's input. I am afraid I will receive a county court claim and would like to know how to respond before receiving this. I am terrible at this stuff and am panicking.

        A lot of these criminals ooppsss DCAs regardless issue County court forms in order to possibly frighten you into submission and do their will, trouble is you have taken the 1st steps to defeat their threats, try not to worry and miss sleep etc, read threads and see the many occasions they give up in the end, or an agreement is made (only if it is felt you have a bad case- rarely), they tend to chase/issue them, without evidence, that is when help on here ois offered etc, so keep us up dated!

          So should i respond to this or ignore? Do you think what they have sent is sufficient? And what about the other CCA they sent to me belonging to someone else?? Sorry for all the questions and I really appreciate the time taken to respond.

              Hi

              Just looking some further input/advice if possible. I have received further paperwork from solicitors sending me what PRA had already sent me, the CCA and the copies of statements advising that I need to fill in an income and expenditure and get back to them to set up some sort of payment arrangement before this Friday or they will issue court claim.

              I am very panicked at this and was wondering should I just contact them and set up a payment plan or is there any way to defend it as they have sent me through what they needed to?

              Also as I haven't contacted them yet they are unaware that I also have (along with mines) a copy of someone else's CCA with all their personal details on!

              I feel that I don't have a defence at all. How likely are they to get a CCJ against me?

                You may feel as if you don't have a Defence but at the moment PRA have not complied with your CCA Request so the debt is unenforceable until or unless they do. That would be your Defence at this moment in time.

                Who are the solicitors who are making you feel so unnecessarily vulnerable?

                    Still the same persons CCA provided but together with your agreement? Does your copy comply fully with the CCA request?

                      Hi

                      Yes I received my agreement and another ladies agreement in the same envelope. I think my agreement complies (i'm not sure). It is attached above. It does say MBNA on it although I thought it should have alliance & leicester logo on it but not sure. It was taken out after 2007 so I guess it is a reconstituted copy? What do you think?

                        When did you open this "old" Alliance & Leicester credit card account?

                        Those Ts & Cs which they've sent you are dated 10th March 2009. Is that about right?

                            Yes our posts did cross

                            It looks as if you made your application online because you've ticked a box to 'sign' it which is acceptable after 2005.

                            I see you also ticked the box for PPI so did you have PPI on this account?

                              Paula looking back at the alleged agreement is that one page all that was provided ? Have you removed personal data from it or was it blank.
