  • one claim or two separate claims to the ET

    Hi

I have taken my employment to an ET for discrimination and whilst this is being processed, waiting for my employer to submit their response, I have been given verbal notice of redundancy with no suitable alternative employment or re-deployment options, despite several posts being vacant. I will be submitting a claim for unfair dismissal and my question is do I need to instigate a fresh claim (Via ACAS) or it can be tagged onto the current one.

    many thanks

You'll need to submit another claim if/when your employment ends.
If the reason for failing to offer you any of the vacant posts (assuming that they could be suitable) is because you claimed discrimination you could add a victimisation claim.
The Tribunal may join the claims, so that they can all be heard together, as part of the case management.

Thank you all, I can't tell you how good it feels to know that perfect strangers are willing to help me and others in exchange for nothing, when facing such difficult and stressful dilemmas.

It can be a very daunting process for someone with no previous experience.
It's so easy to go wrong because you might not know which issues are important and which are irrelevant. People are often shocked to learn that the issues that they feel most strongly about don't matter and the case turns on an issue or technicality that they didn't realise was a problem at all.

Would you like to give us an overview of the situation to see if we can be of further assistance?
          Perhaps things like...
Roughly how long you've worked there.
What kind of discrimination. (Disability, sex, race etc.)
The steps taken to deal with it before making a claim.
When you submitted the claim to ACAS.

Re: one claim or two separate claims to the ET

            Hi again

I have a few more questions but before a bit of information:

Have been worked for a NHS Trust for 11 years in a senior capacity.
The respondent has asked for an extension for the submission of the response form and the date for a pre hearing has been postponed and I am waiting for a new one to be issued,

The discrimination is based on nationality, can someone advise me on what are the main issues the judge will be considering, ? How much evidence do I need to evidence this? would a reasonable belief would be sufficient based on some facts? Where can I get more information?

I have read that it is possible to make an application to the judge for an amendment of a claim. Does anyone know more about this?

I attended a ,meeting last week where a consultation on service reconfiguration was launched. I was told I was facing redundancy (the only one) and that there were no suitable alternative employment or redeployment opportunities for me. I have been asked to attend another meeting 2 weeks later and I am being pressurised to attend. I do not understand why as there are no options for me to discuss and the consultaion has not finished. I have to wait for the ET to consider the comments to the consultation before a final decision is made. What would be the real reason they want to meet with me for? they say is to give me the opportunity to discuss my situation and offer me support but what would be the point?

many thanks for your time and help
