    Hi everyone,

    I am after a bit of advice if anyone can help please?

    We attended Chique Photography for a photo experience and felt pressured and conned into buying the most expensive photo package (no other packages were offered, it was an all or nothing kind of thing!). The employee then did my credit application online with FlexPlan, which was approved.

    I have reflected on the experience and the goods and the selling techniques and decided to log a complaint to Chique but had no response. I then thought that i had 14 days to change my mind about any credit agreement I entered into and decided to cancel it and return all purchases to Chique. I was then told by the finance company that it was uncancellable as I had signed the agreement on the property and it was an unregulated agreement.

    I didnt sign anything to do with the credit agreement, the employee took it upon herself to "click to sign" the online application, I wasnt advised on my cancellation rights, or the lack of them, nor was I given any opportunity to read the terms and conditions of the contract before she helpfully clicked to sign for me. Had I known that I was unable to cancel I would never have agreed to it!

    Do I have any wriggle room or do I just need to suck it up and learn from my experience? I'm really cross as it isnt a small amount of money!.

    Any help or advice would be appreciated.

    And a tip for everyone, don't go to Chique Photography.

    Do you have a copy of the agreement?

    Information to be provided before making an on-premises contract

    9.—(1) Before the consumer is bound by an on-premises contract, the trader must give or make available to the consumer the information described in Schedule 1 in a clear and comprehensible manner, if that information is not already apparent from the context.

    (2) Paragraph (1) does not apply to a contract which involves a day-to-day transaction and is performed immediately at the time when the contract is entered into.

    (3) Any information that the trader gives the consumer as required by this regulation is to be treated as included as a term of the contract.

    (4) A change to any of that information, made before entering into the contract or later, is not effective unless expressly agreed between the consumer and the trader.
