      • August this year, knock on door of my parents (old house) from a bailiff looking for me.
      • Turns out a CCJ was passed for unpaid electricity bills on a tenanted flat I own (June of this year)
      • I researched and found out the company concerned and filed an N244 form.
      • I do not believe I am liable as the flat was tenanted with AST in place and I knew nothing of this as correspondence address was incorrect
      • date of hearing to set aside was sent to me and shows apperance date in October
      • Claimant (big energy company) send me a consent order.

      BY Consent
      1. Set judgement from June aside
      2. defendant is to file full defence within 14 days
      3. no order as to costs

Their cover letter represents that the agree to set judgement aside to allow me to file a full defence and then goes on to say if you don't consent, we'll start preparing to submit a scheduled for court costs etc.

I do not believe the judgement should have stood and wish to file a full defence and list the tenant as responsible party. I signed the consent order. was this the wrong thing to do?? Their cover letter seemed to imply it would be simple...

Help, my wife is 9months pregnant and I am tearing (what is left of my) hair out.

      Thanks
      Hi,

In whose name was the utility account? Yours or the tenants?

Have you ever lived in the property concerned.

What period is the bill for?

Was the flat tenanted for this entire period?

Had the tenancy changed from the previous billing period?
