I am looking for some guidance.
We recently signed up a contract with Anglian for a conservatory. Details of the events in chronological order below -
1) Discussed our requirements and got a quote
2) After price negotiation, we decided to go ahead
3) Site survey was done and the engineer called out a couple of things not included in the price which we had discussed with the sales person and expected to be included in the scope. We signed a contract highlighting the two disputed items.
4) We were told that the 2 items would cost us extra money (~£1,600) but we refuted. Eventually, the sales guy came back and said he can include the 2 items but would cost us £75 extra. We decided to go ahead with the slight change in the price. He was also supposed to show was 2 samples; window sill and red sandstone. He said he would bring them with the revised contract for signature.
5) We looked at the samples and thought they were fine. We were told that the red sandstone sample looked different to our house as its new and it's from a different factory and would be difficult to find a perfect match. We accepted the difference in the look and agreed with the sample
6) In the 'variation of contract', he listed 4 items; 2 that were missed in the 1st contract version and the 2 samples. We thought he listed the samples as he showed them to us (not that it's been swapped with a different item)
7) Today we had a pre-site manager, he explained that it's not red sandstone we signed up for but a red stone. Basically, the sales guy changed one of the items (red sandstone [expensive] with red stone [cheaper]) without our consent to include the 2 items that were missed. As we didn't know the difference between the 2 stones by looking at it, we didn't pick this up in the revised contract.
We feel that we have been duped. We thought we got a good deal that included red sandstone (matching our house build) but now we would have been better off with the other quotes. Anglian are saying either we pay extra for the red sandstone or go ahead with what's on the paper. We are inclined to cancelling the contract as have lost confidence in Anglian (there are other incidents too where their service has been poor) but they are saying we will be charged 30% cancellation fee which is a huge amount when the work is thousands of pounds.
Any guidance on where we stand would be appreciated.
