  • CCJ in wrong name restons solicitors

    Hi I now have an outstanding CCJ (I admitted) with restons solicitors. The original debt was was Cabot LTD. I said I can pay £20 a month but they declined it and now the court day I must pay £40 which I can't afford and was shown on the income forms etc sent back. However I now see and everything addressed to me from the court and the solicitors says my nickname (Rob) not Robert Benson?
    So like:
    Rob Benson
    address.

    Now Cabot sent a letter saying we want payment or we are going to send bailiffs round even though the court letter says it's not due till 5th Sept..
    What should I do? Is it enforceable through the surname is in Rob Benson? And how do I lower the amount without going to a hearing...

    Imho, the issue re your name will likely be regarded as de minimus (trivial).

    You could apply for a variation (form n245 - https://hmctsformfinder.justice.gov....t_forms_id=486 ).

    If you are on a very low income, you could be eligible for court fee remission.

    Could you get to a CAB asap?
