    Hello,
    Its been a while since I used this forum but I need a bit of guidance. I had a personal loan with Northern Rock back in 2006 which was in my name only, i defaulted. Northern Rock took me to court and successfully obtained a ccj, they also obtained a charge on my house. The property is equally owned by my wife and myself.
    Since Northern Rock went bust I have been paying £40 a month first to NRam then to Marlin/Mortimer Clarke for years. The charge on my house is registered with Northern Rock at the land registry.
    is the charge still legal or valid or does Mortimer Clarke now have a right to it or can I appeal and have this removed.
    Would appreciate some good advice/help, thanks again.

    It depends.
    Did Northern Rock got legally taken over Ie they merged into one by law? If so then yes it is still there if they just went defunct and MC now claim they own it, you should ask for paperwork for the orginal charge PLUS the legal one saying they now own it. Let me know what they say. You could try applying to get it gone but it's best doing checks first.

    If you wish to do so the best thing you can do is have your wife solely sell it then no, they can't legally get any money but what so ever you cannot be associated with the sale of the house.

      Thanks, Northern Rock were taken over by the uk government. All the bad debt was sold on to Marlin/ Mortimer Clarke. I have the charging order which was applied for by Wallers solicitors in Newcastle on behalf of Northern a Rock. I think I'll seek out a specialist lawyer who can help, good news is I have no intention of selling the house

        Hi again!
        The charging order will still be active then.
        There isn't much you can do here, and will just end up paying lots of lawyers fees and court costs to try and get rid of it, and if you do manage to get rid of it someone else who owns them will just re-apply for a charging order or possibly a judgement then. Best leaving it for now
