    Hi again,

    Thanks for posting this for me.

    This is all of the terms and conditions.

    The rest of the document is statements/transactions that are perfectly clear. They look like a computer print out.

    In the last letter they sent last week they said I have 14 days to give them reasons why I believe the debt it not enforceable. Do I have a case by saying the t's and C's are not legible?

      Suggestion:

      Can you read through ( if possible) the agreement to see if further T's & C's are mentioned but are not on the form?

      I don't think it's complete.

          Capones " skeleton" agreement is usually followed by a " booklet " containing the full T's & C's.

                I think that that page is unacceptable it's unreadable at any magnification it must be easily legible in all parts.

                  So is the best course of action to tell them why it's unenforceable in writing or offer to pay a reduced fee because it's unenforceable?

                    My stance on faulty agreements being produced in response to a CCA has/is to write stating that one believes that documents purported to be a copy of the agreement are refuted for reasons that I ma sure the claimant and it's solicitors are full aware and suggest that the solicitors advise their client to discontinue the claim.

                        I wouldn't tell them why it's unenforceable because that may only encourage them to remedy the situation.

                        Who sent you that latest letter, Cabot or a solicitor?

                          Mortimer Clarke sent the letter on behalf of Cabot. No claim issued yet. I have about 10'days to respond to the most recent letter or they claim it will go to court.

                                That sounds a bit like a Letter Before Action which may require a response asking them to send you the documents which they intend to rely on in court such as the Default Notice etc.

                                Post up the solicitor's letter with your personal details removed.
