    Hi all,
    Ive been on here before but didnt really get anywhere as i think my situation is rather complicated!! im back now to sort this weight around my neck once and for all!!

    I had a secured loan with Welcome back in 2007. i had difficulty paying from day one. i defaulted in 2010 and it is due to come off my credit file this decmber.
    I havent had any contact with welcome since 2012 ish.
    Welcome sold the debt to MKDP and they are now listed on my credit file - account defaulted etc but this listing hasnt been updated since december 2015.

    i get the odd letter here and there but never reply and then they dissappear for a while.
    I have researched welcome quite a bit and i believe the default notice wasnt correctly issued hence perhaps they sold it to MKDP.
    Could it be that MKDP dont know there is a charge against my property?
    i want to sell my property but there wouldnt be enough equity to pay them off so im stuck!
    any ideas would be greatfully received!

        Have you checked the Land Registry to see if there is charge?

        The Compello Group MKDP /MKRR has been absorbed into another group it may be that this (as has been seen to happen) have slipped through the net.

          There seems to have been some confusion as to whether the charging order was the result of a CCJ which it wasn't. This is a secured loan. The charge is on the property to secure the loan (obviously) not because of any court action. The charge would be there even if all the payments were up to date.

          If you default on the loan then the lender can seek possession of the property through the courts. A 'bad' DN and/or any other defective paperwork may help you to defend your position if that were to be the case (possession proceedings).

          In your case the original lender has changed hands. A lot will depend on what legal rights were assigned to the purchaser. Deeds of Assignment are not all standard. They contain various 'conditions' affecting what the buyer can and can't do with the debt afterwards.

          MKDP was acquired by Hoist Finance last July. The current entry on your CRA files should only show Hoist not MKDP from then on.

          I'm surprised you've not heard anything from Hoist or Robinson Way who are their DCA. You say you've been getting letters so who has been writing to you?

          If your property is in negative equity why do you want/need to sell it since you will still owe the shortfall after any sale?

            Hi Di,
            thanks for your help here, i have checked out a couple details so far - my CRA states MKDP and this was last updated on the 27/12/2015
            on the land registry it states Welcome finance as having a charge. i do have the mortgage company and someone else( another story!) as registered charges but the Welcome one only says charge - not registered charge.

                  Will "Bump" again for you. Been in dispute with this lot ( Welcome) for a long time.
                  You are aware, I am sure; that they are in the process of winding up and are possibly trying to get as much as they can out of any " out standing " loans.
                  Notorious for missing and duff paper work.

                            @Nemesis and [MENTION=87380]Diana M[/MENTION] have far more knowledge than I have!
                            Just know that in over six years they have failed to come up with any evidence of a loan. Have said themselves they cannot enforce or take to court, that didn't stop them trying with two DCA ( Incasso LLP and Mackenzie Hall).
                            Tlhere were thoughts on another thread to bring some sort of mass complaint to the appropriate regulators but nothing concrete about that yet.
